Fluid Bicycle Warranty
Anaconda Group Pty Ltd (Anaconda) warrants to the original purchaser of a Fluid brand bicycle that has a wheel base exceeding 640cm and a wheel size of no less than 40cm purchased from Anaconda (Fluid Bicycle) that the Fluid Bicycle when used for normal, private and recreational riding purposes and specific parts of the Fluid Bicycle as set out in this warranty are free from material defects if manufacturing, workmanship and materials for the periods specified in this warranty (Warranty).
Scope and Duration
This Warranty applies to the following parts of the Fluid Bicycle for the following periods commencing on the date of purchase from Anaconda by the original purchaser:

*Lifetime does not mean forever but a reasonable lifetime. The lifetime of a bicycle will vary and can be influenced by factors such as the type of bicycle, riding conditions, care and maintenance
Exclusions
This Warranty does not apply where the Fluid Bicycle or any part of it:
- fails, malfunctions or becomes defective due to an accident, neglect, abuse, normal wear and tear, misuse, lack of rider skill, incorrect shifting of gears or shifting under heavy load; improper operation, improper assembly, improper transport, improper or lack of repair or maintenance, failure to follow the owner’s manual, alteration, modification, or any other abnormal, excessive or improper use;
- has been subjected to a use for which it was not designed or intended or promoted by Anaconda, including but not limited to jumping, stunt or trick riding, participation in ‘motocross’, mountain bicycle racing, downhill racing, competitive racing, aggressive riding, riding on severe terrain or in severe climates, riding with heavy loads, any use not recommended in the owner’s manual or any similar activities;
- has had a motor attached or has been used for hire, rental or any other commercial purpose;
- has been modified or is otherwise than as supplied by Anaconda;
- does not consist solely or original parts or equipment as supplied by Anaconda;
- is defective, damaged, malfunctioning or otherwise failing as a result of normal wear and tear, including the results of fatigue; or
- has been ridden by a rider who was too heavy for the specific Fluid Bicycle, which includes but is not limited to:

- for youth bikes - riders who were taller than the height range indicated at the point of sale or on the Anaconda website or specified by an authorised Anaconda salesperson at the time of purchase
- for Fluid Sprint 1.0, Fluid Express, and Folding bikes - riders who weighed more than 100kg
- for all other adult Fluid bikes – riders who weighed more than 120kg.
In addition to the exclusions referred to above, this Warranty does not cover:
(a) surface rust or blemishes or structural rust;
(b) fading or other discolouration of paint or any other material;
(c) normal wear and tear or fatigue, including but not limited to tyres, chains, grips, seats and pedals.
This Warranty only applies to the original purchaser being the person who purchased the Fluid Bicycle from Anaconda. This Warranty cannot be assigned or transferred by the original purchaser to any other person.
How to make a claim under this warranty
In order to make a claim under this Warranty, the original purchaser must deliver the Fluid Bicycle to an Anaconda store together with proof of purchase and details of the alleged defect.
Proof of purchase includes but is t necessarily limited to the receipt issued by Anaconda for the purchase of the Fluid Bicycle. Other types of proof of purchase will be assessed on a case by case basis by Anaconda.
All expenses in making a claim under this warranty are to be borne by the original purchaser unless prior written approval has been given by Anaconda to the original purchaser.
Remedies
In order to assess a claim made under this Warranty, Anaconda may require the Fluid Bicycle to be left at an Anaconda store for assessment or be sent to an external assessor by Anaconda. If the original purchaser makes a claim under this Warranty within the Warranty Period and Anaconda finds there is a defect with Fluid Bicycle that is covered by this warranty, then Anaconda will, in its sole discretion, either:
(a) refund the purchase price paid by the original purchaser or
(b) replace the Fluid Bicycle or the defective part with an identical or similar bicycle or part free of charge. Anaconda reserves the right to replace defective parts with parts and components of similar quality, grade and composition where an identical part or component is not available; or
(c) repair the Fluid Bicycle or the defective part free of charge. Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the Fluid Bicycle or a defective part.
Australian Consumer Law
The benefits to the consumer given by this Warranty are in addition to other rights and remedies of the consumer under the Australian Consumer Law, which is contained in Schedule 2 to the Competition and Consumer Act 2010) and any other law that applies in relation to the Fluid Bicycle.
